The General Data Protection Regulation (GDPR) was introduced on 25 May 2018. It affects everyone who does business with EU citizens and will affect business of all sizes. The Regulations deal with the holding and processing of personal data of Europeans.
Most people will have received a large number of emails from organisations pointing out new privacy policies and / or asking people to 'opt in' or re-subscribe to promotional material and emails.
However, the advice to 'opt in' again may have been over zealous.
Businesses are being advised to check what advice they were given at the time GDPR was introduced. The reason for this is that some of the advice may have been incorrect.
Some business have, according to one industry expert, been told to concentrate on consent as the basis for processing personal data and his view is that this is incorrect.
Perhaps unsurprisingly, the initial advice was cautious and businesses have tried to obtain consent (sometimes twice) to give it the right to keep customer details. This may have led some businesses to lose customers as a result.
It might be prudent for businesses to check the advice that they were given about implementation the GDPR, especially if subscribers or customers have fallen since the implementation of any advice.
